Civil Tort for Domestic Violence and Abuse

Tort Litigation and Personal Injury Claims

This civil litigation, filed in King County Superior Court, sought to hold the Defendant accountable for a sustained pattern of conduct that the complaint characterizes as domestic violence and sexual assault. According to the allegations set forth in the complaint, Bloom suffered extensive physical, sexual and psychological injuries resulting from acts of assault, battery, sexual assault and coercive control. The lawsuit asserted that these actions were directed at Bloom and her minor children for the purpose of causing harm and maintaining dominance throughout the relationship.

Per the filed complaint, Bloom alleged that the Defendant’s conduct included physical violence, forced sexual acts, and incidents of strangulation, one of which purportedly resulted in a traumatic brain injury diagnosis. The litigation further asserted that the Defendant engaged in a campaign of psychological abuse and false imprisonment that caused Bloom to experience a persistent fear for her life and the safety of her children. These claims were supported in the pleadings by references to medical documentation and therapeutic diagnoses that track the long term impact of the alleged abuse.

Demonstrating significant legal acumen regarding the use of civil torts to address domestic violence, this case framed these private wrongs as a matter of fundamental rights and personal security. The complaint argued that the Defendant’s behavior met the legal threshold for the intentional infliction of emotional distress and sought damages to compensate for the resulting trauma and to deter future misconduct. Subsequent to the filing of the action, a settlement was reached by Allstate on behalf of the Defendant, resulting in the formal closure of the case.

This litigation highlights a critically underutilized legal path for survivors of domestic violence and sexual assault seeking justice outside of the criminal justice system. Given that Washington currently ranks ninth highest in the country for domestic violence prevalence, the low rates of criminal prosecution leave many survivors without recourse.
